CLOUDY-SOFA — TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of https://www.cloudy-sofa.com (the "Site") and any purchase you make from it. The Site is operated by Cloudy-Sofa ("we", "us", "our"), 229 Rue Saint-Honoré, 75001 Paris, France. By accessing the Site or placing an order, you agree to these Terms.

1. ELIGIBILITY
You must be at least 18 years old to place an order.

2. PRODUCTS
- Our Cloud sofas, armchairs, poufs, and beds are made to order in the configuration, fabric, and colour you select.
- Because items are handcrafted, slight variations in colour, texture, and dimensions are normal and do not constitute a defect.
- Product images are for illustration; on-screen colours may differ from the actual product.
- We try to display products accurately, but we do not warrant that descriptions or other content are error-free.

3. PRICING AND PAYMENT
- All prices are listed in euros (EUR €) and include VAT where applicable, as indicated at checkout.
- We may change prices at any time before you place an order.
- Payment is taken at the time of order through our payment providers. Your order is an offer to buy; a contract is formed only when we confirm acceptance and/or dispatch.
- We reserve the right to refuse or cancel any order (for example, suspected fraud or pricing errors) and will refund any amount already paid.

4. ORDERS
You are responsible for providing accurate shipping and contact details. We are not liable for delays or failed delivery caused by incorrect information.

5. SHIPPING
Delivery is governed by our Shipping Policy. Orders are processed within 3 to 5 business days and delivered worldwide within 5 to 14 days, with free delivery.

6. RETURNS AND REFUNDS
Returns and refunds are governed by our Refund & Return Policy, including our 100-night trial. Please note that personalized and made-to-order items are excluded from the statutory 14-day right of withdrawal under article L221-28 of the French Consumer Code.

7. WARRANTY
Our products are covered by the Cloudy-Sofa 5-year structural warranty as described in our Warranty page. This does not affect your statutory rights.

8. INTELLECTUAL PROPERTY
All content on the Site (text, images, logos, designs) is owned by or licensed to Cloudy-Sofa and is protected by intellectual property laws. You may not copy, reproduce, or use it without our prior written consent.

9. PROHIBITED USES
You agree not to use the Site for any unlawful purpose, to infringe our rights, to transmit harmful code, or to interfere with the Site's operation.

10. DISCLAIMERS
The Site and products are provided "as is" to the fullest extent permitted by law. We do not guarantee that the Site will be uninterrupted or error-free.

11. LIMITATION OF LIABILITY
To the maximum extent permitted by law, our total liability arising out of or relating to your use of the Site or any product is limited to the amount you paid for the relevant order. We are not liable for indirect or consequential losses. Nothing in these Terms excludes liability that cannot be excluded by law.

12. INDEMNIFICATION
You agree to indemnify and hold us harmless from any claim arising out of your breach of these Terms or misuse of the Site.

13. GOVERNING LAW
These Terms are governed by French law. Any dispute is subject to the jurisdiction of the competent courts of Paris, France, without prejudice to the mandatory consumer protections of your country of residence. EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

14. CHANGES
We may update these Terms at any time. The version in force is the one published on the Site at the time of your order.
